Listing Terms

Between: SWPPP HQ, operated by Craig Chambers, Anderson, SC ("we", "us"), [email protected], and the business or person requesting or managing a listing ("you").

1. What these terms cover

These terms apply to free listings you request, correct, or manage in the SWPPP HQ directory. By requesting a listing, or editing a listing, you agree to them.

We don't sell paid listings right now. If we start, we'll post the price and terms here before anyone can buy, and they'll apply only to people who sign up for them.

2. Types of listings

a. Free listing.

• A free listing shows your business name, counties served, service types, phone or email, website link, and any certification you report, with a link to Clemson's list.
• It appears in the county and service search. It stays free, and nobody pays to appear in the free listings. We won't start charging for a free listing, and changes to these terms won't make it paid. You may ask us to correct or remove it.

3. Your responsibilities

You promise that:

• You're authorized to manage the listing for this business.
• Your information is true and current: business name, contact details, services, service area, certifications, and licenses. You'll update us within 30 days if anything changes or expires.
• Licenses and certifications.
  • You hold every license, registration, and certification your listing claims or that your listed services legally require.
  • We don't accept listings that offer SWPPP or C-SWPPP preparation, engineering, surveying, or landscape architecture.
  • No owner, partner, or principal of your business is a licensed professional engineer (PE) or surveyor, and your business offers no engineering or surveying services. If that changes, you'll tell us and we'll remove the listing.
  • Your listing won't describe you as an engineer, surveyor, or landscape architect, or offer design, plan or SWPPP preparation, or certification of compliance.
• Insurance. You carry any insurance the law, your clients, or your services require. We don't verify insurance.
• Your listing content is lawful and accurate.
  • It contains no false or misleading claims, and nothing that suggests government, SCDES, or Clemson approval or affiliation.
  • It doesn't use any agency's or university's logo or seal.
  • It doesn't infringe anyone's rights, and it follows the advertising and solicitation rules of your own licensing board.
• You own or have the right to use the text you give us. You grant us a non-exclusive license to display it on the site for your listing. We may refuse or remove it at any time.

4. What we do and don't check

• We check public credentials only. Before a listing goes live:
  • We compare any certification number you give us against Clemson's public lists.
• We don't verify insurance, quality of work, business standing, or other claims. We rely on your promises in section 3.

5. No endorsement

• Being listed doesn't mean we recommend, verify, or endorse a business, or that it endorses us or is our customer.
• We don't guarantee any number of views, calls, or jobs.

6. Our right to refuse, shorten, or remove listings

We may refuse, shorten, reformat, suspend, or remove any listing at any time. We won't change what a listing says about your business without asking you. Examples include when:

• information appears inaccurate
• a license or certification has expired or can't be confirmed
• we receive a credible complaint
• content breaks these terms or the law
• the person listed asks us to remove a free listing
• we stop running the directory or a region

7. Corrections and removal requests

• Anyone listed may ask us to correct or remove their listing by emailing [email protected] (subject "Correction" or "Removal").
• We'll act within 10 business days.
• Removing a listing from our site doesn't change Clemson's or any agency's records.
• See our Privacy Policy for how we handle the information.

8. Data accuracy

• Directory and guide information comes from you, from public sources, and from our own work. It may be incomplete, out of date, or wrong.
• The directory is provided "as is" and "as available".
• To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy.

9. Limitation of liability

• To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or business, arising from the directory or your listing.
• Our total liability for all claims about your listing is limited to $100.

10. Indemnity

You'll defend and indemnify us against third-party claims arising from your listing content, your services, or your breach of these terms.

11. Changes to these terms

• We may update these terms by posting a new version with a new effective date.

12. Governing law and venue

• These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules.
• Any dispute will be brought in the state or federal courts located in Anderson County, South Carolina.

13. Other

• These terms, plus the Privacy Policy and the listing details you submitted, are the whole agreement about your listing.
• If any part is unenforceable, the rest still applies.
• You may not transfer your listing without our consent.
